Snow Removal Terms of Service

Your Agreement with Texo Terra Contracting Ltd.

1. Scope of Snow Removal Services

Snow clearing refers to the mechanical removal of snow from designated driveway areas to an adjacent permissible location. Services such as snow stacking, hauling, sanding, salting, de-icing, manual shoveling, or ice removal are not included unless explicitly stated in writing.

2. Service Trigger & Scheduling

Snow clearing services will commence once snowfall accumulation reaches approximately 5 cm (2 inches). This includes follow-up visits after municipal or sidewalk plowing and additional clearing during extended or heavy snowfall events. Service timing may vary depending on storm conditions and operational demands. The Contractor is authorized to access the property and perform snow clearing at any time during qualifying snowfall events.

If adequate snow storage space is unavailable on the client’s property, the client agrees to permit snow placement along the driveway edge or to coordinate alternative arrangements with adjacent property owners.

3. Contract Term

This agreement is effective from November 1 to April 1 of the applicable season, or until a cumulative snowfall of 300 cm (10 feet) is reached—whichever occurs first.

If vehicles are parked in the driveway during scheduled service times, only areas accessible from the street will be cleared.

4. Property Preparation & Damage Disclaimer

The Contractor is not responsible for damage to items located within the snow removal area, including but not limited to garbage or recycling bins, basketball nets, toys, plant pots, hockey equipment, extension cords, or seasonal decorations. Clients are responsible for removing personal items prior to snowfall.

Basketball nets must be raised or repositioned to provide a minimum clearance of 10 feet. Gutter downspout extensions must be removed before winter. Any elevated water main caps, pavers, or obstructions should be leveled with surrounding surfaces.

The Contractor is not liable for scratches, surface marks, rust stains, or damage to asphalt, interlock, or concrete that is uneven, heaved, chipped, or previously compromised.

5. Safety & Liability

Texo Terra Contracting Ltd. is responsible solely for snow clearing services and does not guarantee a slip-free or ice-free surface. The Contractor is not liable for personal injuries, slip-and-fall incidents, or damages caused by icy or slippery conditions.

By accepting service, the client waives, releases, and discharges Texo Terra Contracting Ltd., its directors, officers, employees, and agents from all liability, including claims arising from negligence, personal injury, property damage, or loss. The client further agrees to indemnify and hold harmless the Contractor from any related claims.

6. Exclusions

This service does not include:

  • Snow resulting from roof clearing or drifting
  • Ice removal caused by freezing rain or sleet
  • Manual shoveling in areas inaccessible to equipment
  • Clearing in front of garage doors, steps, or walkways
  • Compact snow or ice buildup unless otherwise agreed

7. Markers & Visibility

The Contractor will place two border markers at the street end of the driveway. The client is responsible for supplying and installing additional markers around retaining walls, steps, raised patios, or ramps that may become obscured by snow.

8. Payment & Contract Termination

Failure to make payments or comply with these terms may result in immediate termination of service, releasing the Contractor from further obligations. If the Contractor is found to be in breach of this agreement, the client may cancel the contract and receive a refund of any unused prepaid amounts.

In the event of property sale or re-occupancy, this agreement remains in effect and may be transferred to new occupants or another eligible property within the Contractor’s service area. Refunds will not be issued for early termination due to relocation.
